1. Acceptance of these terms

By creating a Bookitly account, or by booking an appointment through a Bookitly provider's booking page, you agree to these terms and conditions. If you do not agree, please do not use the platform.

2. What Bookitly is

Bookitly is a booking management platform for South African solo service providers and small teams (hair salons, barbers, nail technicians, beauty therapists, and similar businesses). We provide the technology that lets providers manage their schedule and lets clients book appointments online — we are not a party to the service being booked, and we do not employ, vet, or supervise providers. The provider is solely responsible for the quality, pricing, and fulfilment of the service.

3. Eligibility and your account

You must be 18 or older to create a provider account. You're responsible for keeping your login details confidential and for the accuracy of the information on your account and booking page. We may suspend or terminate an account that contains false information or that we reasonably believe is being used fraudulently.

4. Provider responsibilities

Providers are responsible for the accuracy of their listed services, prices, working hours, and availability, and for honouring confirmed appointments. Providers set their own cancellation and no-show policy and are responsible for communicating it to clients.

5. Client responsibilities

Clients booking through a Bookitly page are responsible for attending appointments at the agreed time, or cancelling with reasonable notice so the provider can offer the slot to someone else.

6. Subscription plans and billing

Bookitly offers a Free plan and a paid Pro plan, billed monthly in South African Rand. Pro subscriptions renew automatically each month until cancelled. You can cancel at any time from within the app; cancelling stops future billing but we do not refund the current billing period. We may change plan pricing or features with reasonable notice to active subscribers.

7. Payments between providers and clients

Bookitly does not currently process or hold payment for the services booked through the platform — payment for the appointment itself is handled directly between the provider and the client, by whatever method they agree on. Bookitly is not responsible for, and accepts no liability arising from, disputes about payment for services. If in-app payment collection (for example, deposits via PayFast) is introduced in a future version, this section will be updated before that feature goes live.

8. Bookings, cancellations and no-shows

A booking is confirmed once a client receives a confirmation through the platform. Either the provider or the client may cancel a confirmed booking; Bookitly is not liable for any loss arising from a cancellation, no-show, or unfulfilled appointment. SMS reminders are sent on a best-effort basis and are not guaranteed to be delivered.

9. Acceptable use

You may not use Bookitly to send unlawful, abusive, or fraudulent communications, to harvest data from the platform, to interfere with its operation, or to impersonate another person or business. We may suspend or remove access for accounts that breach this section, without refund of any subscription fees already paid.

10. Intellectual property

Bookitly and its logo, design, and underlying software are owned by us. Providers retain ownership of the content they upload (photos, service descriptions, business bio) but grant us a licence to display that content as part of operating their booking page.

11. Limitation of liability

Bookitly is provided on an "as is" basis. We do not guarantee the platform will be uninterrupted, error-free, or available at all times. To the maximum extent permitted by South African law, Bookitly's total liability for any claim arising from use of the platform is limited to the subscription fees you paid us in the three months before the claim arose, except where liability cannot lawfully be limited (for example, in cases of fraud or wilful misconduct).

12. Indemnity

You agree to indemnify Bookitly against any claim, loss, or cost arising from your breach of these terms, your misuse of the platform, or a dispute between you and a provider or client.

13. Suspension and termination

We may suspend or terminate an account immediately if we reasonably believe it poses a fraud, security, or integrity risk to the platform, or breaches these terms. You may close your account at any time; we will handle your data on closure as described in our Privacy Policy.

14. Data and privacy

Our use of your personal information is described in our Privacy Policy, which forms part of these terms.

15. Changes to these terms

We may update these terms from time to time. If we make a material change, we'll make reasonable efforts to notify active account holders. Continuing to use Bookitly after an update means you accept the revised terms.

16. Governing law and jurisdiction

These terms are governed by the laws of the Republic of South Africa, and any dispute will be subject to the exclusive jurisdiction of the South African courts. Before either party starts formal proceedings, we ask that you contact us so we can try to resolve the issue directly.
